Our booking terms & conditions

Before you get too excited about your adventure, we need to deal with the boring red tape stuff.

Please read this agreement carefully before you pay, as in order to participate in one of our adventures, you agree to accept and be bound by these terms and conditions.

We’re not a commercial organisation and are volunteering to arrange these trips so that we can make adventures like these more accessible to women worldwide.

This site is just a platform for us to communicate and organise logistics easily between our community members, we are not a holiday business or tour operator.

We’re taking payments up front so we can pay for accommodation in advance and know that we have sufficient funds to pay the guides in case members do not show up to pay on the day.

RISKS

Please read and understand the following participation statement:

“The British Mountaineering Council recognises that climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement.”

In addition, we’re an inclusive club that allows members of any standard to join, our ethos is to help people grow in confidence outdoors. This means there are no minimum entry requirements and members HAVE NOT BEEN VETTED to ensure they are safe to climb with.

It is your responsibility to check that the people you’re climbing with are safe to do so, just as you would having met someone on other websites or in other clubs. If you’re unable to make that decision, then make sure you climb with someone you know and trust with your safety.

If you feel unsafe or unsure at any time, stop the activity and do tell us if you feel a member of the community has unsafe practices.

adventure AGREEMENT

Definitions

 (a)       References to “you” and “your” means the persons named in the booking (including any person or persons added or substituted subsequently).

(b)       “we” “us” and “our” means organisers of Women’s Alpine Adventure Club, and any contractors, partners, volunteers, accommodation hosts and guides working with us.

(c)       References to “Adventure” means the services we have agreed to provide to or provide you with under your booking with us.

(d) References to “Losses” means any amount related to but not limited to preparation costs, airfare, travel documents, or any other potential losses, damages, costs, expenses, or liabilities.

1     Our terms

These terms and conditions, which are governed by English law and the jurisdiction of the English Courts. You may choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so and you are resident in Scotland or Northern Ireland.

1.1 When you make your booking you agree that you have authority to accept and do accept on behalf of the party named in your booking, these terms and conditions.

You confirm all participants named in the booking are over 18 years of age.

1.2    You are responsible for making all payments due to us under the booking. All party members named within the booking are jointly and severally liable for all payments due under the booking.

1.3 We reserve the right to refuse to accept bookings in our absolute discretion without stating the reason for doing so.

2.0 Payment schedule

2.1 You need to pay the full amount specified on the event page of our website for each person listed on the booking. 

2.2 Booking fees are non-refundable and may not be transferred to another participant other than those described in the booking reservation.

3.0     Cancellation policy

3.1 If you cancel no refund is due.

3.2 All cancellations by you must be in writing and emailed to us at the contact email address specified on the website.

3.4 If we need to cancel due to lack of participants or any other commercial reason, you will receive a full refund of the amount you have paid us but we will not be responsible for any other Losses.

4.0         Accommodation & Facilities

4.1 We feature accommodation on this site so members can stay together at the same place but you can feel free to book your own too.

4.2 We do not always vet or know accommodation in advance so cannot be responsible for quality.

4.3 Do treat the accommodation as if it is your own home and respect it well.

4.4 We do not accept any liability for Losses arising out of use of this accommodation.

5.0         Activities

5.1 Some of our activities are subject to availability of additional instructors and things outside our control such as the weather, so certain activities may be changed or cancelled at our discretion. 

5.2 We reserve the right to make changes to any and all aspects of the Adventure such as activities, itinerary, nature of classes if we deem it necessary to do so.  You will not be eligible for any refunds of any amounts based on any such changes to the Adventure. 

5.3 You acknowledge that you are voluntarily participating in the Adventure, which may include strenuous physical activity including without limitation walking, running, hiking, ice climbing, skiing, swimming, yoga and various other exercises or physical activity.

5.4 You acknowledge that you are fully aware of the risks and hazards connected with participation in the Adventure and/or engaging in physical activity, which may include the risk of serious injury (e.g., heart attacks, muscle strains, pulls, tears, broken bones, shin splints, and other illnesses) or death, and you hereby elect to voluntarily participate in such physical activities as part of the Adventure. 

5.4 You must ensure that you are medically and physically fit to participate, and are at a level appropriate to participate in, and are fully capable of participating in, the Adventure. If you have an injury or illness, please seek doctor’s advice before booking.

5.5 You further represent that you do not suffer from any medical conditions or disabilities that may restrict, limit, prevent, or preclude your participation in the Adventure, including any physical activities.

5.6 You must inform the guide/instructor of any previous injuries.

5.7 If, at any time, you have any doubts about your physical condition or fitness to participate in any aspect of the Adventure, you will cease participation and seek appropriate medical attention.

5.8 You are hereby advised that the Adventure may take place in remote areas where there is little or no access to traditional medical services or hospital facilities for serious health issues (or your particular health issues).

5.9 You are further advised that any medical or evacuation expenses will be your sole responsibility. As a result, we strongly encourage you to purchase travel insurance with appropriate coverage for your needs and the activities we will be doing.

5.10 We reserve the right in our sole discretion to refuse your participation in the Adventure, any workshops, and/or any other activities, due to medical, fitness, or other grounds.

5.11 We also reserve the right to deny participation in the Adventure or any related activities at any time to individuals demonstrating behaviour that may result in injury to themselves or others.

6.0         ASSUMPTION OF RISK

6.1 Some of the activities inherently carry an element of risk. By participating in the activity you are assuming responsibility for your own safety and take any instruction seriously to protect yourself.

6.2 You understand that serious accidents may occur during physical activities, including without limitation yoga and workshops, mountain activities and that participants can sustain fatal and/or serious personal injury. Understanding and in full consideration of the foregoing, you agree to solely and exclusively assume full and complete responsibility for and the risks inherent in travel and engaging in physical activity which may include injury, death, property damage, and/or any other kind of liability, whether foreseen or unforeseen, which may occur during your participation in the retreat.

6.3 You acknowledge that your decision to participate in the Adventure is made in full consideration of the foregoing information and that you solely and exclusively assume the risks involved with participating in the retreat. In no event will we be liable for any liabilities arising from or in connection with your participation in the retreat.

7.0         LIABILITIES & INSURANCE

7.1 You will need valid travel and activity insurance. In the event you are injured while participating in the Adventure, you agree to assume all financial obligations for any and all medical costs you incur.  You acknowledge and agree that in no event shall we or anyone working for us be liable or responsible for any Losses or liabilities arising out of your participation in the Adventure.

7.2 You are solely responsible for the cost of any travel insurance and ensuring that you are adequately insured for the full duration of the retreat with respect to possible illness, injury, death, property damage, loss of baggage and personal items, cancellation and/or curtailment, and/or any Losses.

7.3 You will be solely responsible for any Losses related to your failure to procure travel insurance. We are not responsible for any Losses you incur and/or sustain. 

7.4 We cannot accept liability for loss, damage, injury or illnesses which may be received during your stay and/or travelling to and from our Adventures.

7.5 In consideration for participating in the Adventure, you voluntarily assume full responsibility for and hereby release, waive, discharge, hold harmless, and covenant not to sue the company, members, agents, contractors, employees, volunteers, guides for any and all claims, demands, actions, causes of action, and/or losses (including but not limited to medical expenses, lost wages/income, property damage, pain, illness and death) arising out or in any way related to your travel and/or participation in the retreat regardless of whether such liabilities are caused by the negligence of any party related to us.

7.6 It is your express intent that this Agreement shall bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representative, if you are deceased, and shall be deemed as a release, waiver, discharge, and covenant not to sue us or any party related to us.

8.0     ALLERGEN ENVIRONMENT
8.1 An environment free of allergens, including but not limited to food allergens, cannot be guaranteed on the Adventure. Therefore, we cannot guarantee that any particular food product is free of all traces of any particular allergen, that consumption of a food product will not result in some form of allergic reaction, or that the participant will not come into contact with any allergens while in attendance on the retreat.

8.2  You acknowledge and agree that you are aware of such risks and that participation in the retreat will expose you to food, activities and persons that may result in exposure to allergens and injury and, in that regard and assuming such risks, you fully release us from any and all liability, or any third party for death and/or injuries to the participant, and/or any Losses that arise out of or relate to participant’s participation in the retreat and/or exposure to food allergens.

9.0      PHOTOS, VIDEO, OTHER MEDIA RELEASE

9.1 By and in consideration for being permitted to participate in the Adventure, you irrevocably grant us all rights to use, reproduce, display, exhibit, publish, distribute, and/or produce derivative works based on your image, likeness, and voice as recorded by any camera and/or on any video, audio, and/or other media (collectively, “Likeness”) worldwide, in perpetuity, without compensation, payment, or other additional consideration of any kind, for any lawful purpose, including without limitation for marketing and trade purposes.

9.2 You agree that your Likeness may be used, reproduced, displayed, exhibited, published, edited, or distributed by us.  

9.3 You understand that your Likeness may be used in various publications, promotional or marketing materials, and/or social media, unrestricted by time or geographic area and consent to such uses.

9.4 You further understand and grant permission to us to electronically display any Likeness of you on the Internet or in other public settings.

9.5 You hereby waive the right to inspect or approve any and all materials in which your Likeness may appear. You further waive any right to royalties or other compensation arising or related to the use of your Likeness.

9.6 This release applies to all photographic, audio, and/or video recordings collected as part of, in connection with, and/or during the retreat (by us or any third party). There is no time limit on the validity of this release nor is there any geographic limitation on where materials including your Likeness may be used, reproduced, displayed, exhibited, published, and/or distributed by or on our behalf.

10.0 PRIVACY POLICY

We are committed to protecting & respecting your privacy.

10.1 Any personal data that you submit will be retained by us for as long as you use our services. Financial data you submit will not be stored or recorded.

10.2 Unless we are obliged or permitted by law to do so, your data will not be disclosed to third parties.

10.3 All personal data is stored securely in accordance with the principles of the Data Protection Act 1998.

10.4 Any or all of the above data may be required by us from time to time in order to provide you with the best possible service, specifically data may be used by us for the following;

·      Internal record keeping.

·      To help to improve our products & services.

·      To transmit via e-mail details of our products & services which may be of interest to you.

·      Contact for market research purposes, which can include e-mail, telephone, postal mail.
